**Bytesis Ltd. Terms of Service**

Welcome to Bytesis Ltd. ([https://www.bytesis.com](https://www.bytesis.com)). By accessing and using our services, you agree to be bound by the following Terms of Service (“Terms”) along with our Privacy Policy and Acceptable Use Policy (AUP). These terms form a legally binding agreement between you (“Client”, “Customer”, “You”) and Bytesis Ltd. (“We”, “Us”, “Our”).
These Terms may be updated or changed at any time without prior notice. It is your responsibility to review these Terms regularly. Continued use of our services indicates your acceptance of any changes.

### 1. Eligibility and Coverage
These Terms apply to all users of our services, whether you are an individual or representing an organization. If you are an individual, these Terms apply to anyone who accesses the service through your account. If you are a business or reseller, these Terms apply to your clients, employees, agents, or representatives who access the services.
Violation of these Terms by anyone who accesses our services through your account will be treated as a violation by you.

### 2. Domain Registration and Management
* Bytesis Ltd. does not guarantee the availability or successful registration of any domain name.
* Registration is governed by third-party registrars, including but not limited to ICANN, and other domain authorities.
* All domain-related fees are non-refundable.
* We are not responsible for failed domain registration or loss of a domain due to expiration, incorrect registration details, or registry policy violations.
* A domain cannot be transferred out unless all dues are cleared.
You agree to comply with the registration authority’s terms (e.g., ICANN, BTCL for .bd domains) and understand that disputes or rejections of registration must be resolved directly with the registrar.

### 3. Service Orders, Payments & Billing
* All services are provided on a prepaid basis unless otherwise agreed.
* Payment is due before service activation or renewal.
* Invoices are due on the date issued. A service may be suspended after 1 day of overdue payment and permanently terminated after 7 days.
* You are responsible for any additional charges due to abuse or excessive usage.
* Excess funds added to the account will be stored as credit and are non-refundable.
* Promotional services, setup fees, and custom work are excluded from refunds.

### 4. Refund Policy
We offer a 30-day money-back guarantee on shared hosting services only. The following are not eligible for refunds:
* Domain names, SSL certificates, dedicated IPs
* VPS, VDS, Dedicated servers
* Web design, development, and any custom technical service
* Services terminated due to violation of our Acceptable Use Policy (AUP)
* Accounts purchased under promotion or with promo codes
* Bulk SMS credits or Reseller credit balance
Any request for refund must be submitted via support ticket. Refunds, if approved, will be issued to the original payment method.

### 5. Service Delivery
All services are delivered electronically. Upon successful payment, delivery details will be sent via email. If there is a delay in service delivery, it will be communicated promptly. You are responsible for keeping your contact information accurate and up-to-date.

### 6. Data Backup and Recovery
Bytesis Ltd. does not provide default data backups for any service unless explicitly stated or purchased.
* Any backup we provide is a courtesy and not guaranteed.
* Restoration of data is at our discretion and subject to service availability.
* VPS/VDS/Dedicated servers do not include data backups by default.
* It is your sole responsibility to maintain your own backups.
* Third-party backup solutions can be arranged for an additional fee.

### 7. Acceptable Use Policy (AUP)
You agree not to use our services to:
* Host illegal or copyrighted content without rights
* Engage in spamming, phishing, or malicious activities
* Host adult/pornographic content
* Store or distribute pirated software or media (warez, cracks, etc.)
* Use the hosting as a backup service
* Host game servers, proxies, VPNs, or IRC servers
* Run applications causing high CPU/IO/network loads (e.g., crypto mining)
* Perform denial of service (DoS) or related attacks
* Host misleading/fake websites
* Engage in harassment or abusive behavior toward staff or other users
Violation of AUP may lead to immediate suspension or termination without notice.

### 8. Account Verification
Bytesis Ltd. may require identity verification through National ID, Passport, and/or facial recognition for fraud prevention and account security.
Failure to provide valid information may result in service suspension or denial.

### 9. Privacy and Data Collection
We collect user information as required for account setup, billing, service improvement, and legal compliance. This includes:
* Name, address, email, and contact number
* IP address and session usage
* Server utilization data
* Support communication logs
We do not sell your data to third parties. Data may be shared with:
* Legal authorities when required
* Payment processors for transaction verification
* Partners performing services on our behalf (bound by confidentiality)

### 10. Communication
We may contact you through email, SMS, phone, or push notifications regarding your services, promotions, or account activity. You may opt out of marketing messages at any time through your account area.

### 11. SLA – Uptime Guarantee
We guarantee 98% uptime monthly for shared hosting. In the event of a shortfall:
* One month credit may be requested within 7 days of outage evidence
* Planned maintenance is excluded from SLA
* VPS/Dedicated servers do not include SLA unless specified in writing

### 12. Reseller Policy
Resellers may offer our services to their own clients but may not offer free hosting. We will migrate up to 10 accounts free of charge; additional accounts are billed at BDT 2000/account.
Resellers must ensure their clients adhere to our Terms and AUP. Any violation by a reseller’s client will be treated as a violation by the reseller.

### 13. Suspension and Termination
We reserve the right to suspend or terminate accounts under the following conditions:
* Failure to pay on time
* Violation of Terms or AUP
* Legal requirement
* Fraudulent or abusive behavior
* Incomplete or false identity/information
* Disruption of our network or services
Chargebacks will result in immediate account suspension and service termination.

### 14. Security & Liability
* You are responsible for securing your account, passwords, and data.
* Unauthorized access must be reported immediately.
* Bytesis Ltd. is not responsible for data loss, hacking, or breach unless explicitly caused by our negligence.
* We disclaim all warranties related to service fitness, reliability, or uninterrupted availability.
* You agree to indemnify Bytesis Ltd. from any claims resulting from your use of our services.

### 15. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes shall be handled through arbitration or the courts of Dhaka.

### 16. Amendments
We reserve the right to modify these Terms at any time. Changes will be posted on our website. Continued use of our services constitutes acceptance of the revised Terms.

### 17. Cancellation Procedure
To cancel a service:
* Login to your client area
* Request cancellation via the respective service tab
* Immediate cancellation results in service termination within 24 hours
Pending invoices must be cleared before cancellation. No other cancellation methods (email/chat) are accepted.

### 19. Prohibited Content
The following types of content are prohibited on our servers:
* Pornographic or sexually explicit material
* Violent, hateful, or abusive content
* Pirated software, movies, or music
* Phishing or scam websites
* Sites violating intellectual property laws
* Cryptocurrency mining
* High CPU and IO scripts
Violations may result in account suspension or termination without refund.

### 20. Resource Usage
You may not:
* Use more than 10% of CPU or RAM for over 60 seconds
* Run cron jobs at intervals below 15 minutes
* Use hosting as file/image storage
* Run chat servers, game servers, or torrent services
Violations may incur additional charges or suspension.
